Fair Debt Collection and Consumer Protection

When individuals are faced with difficult financial circumstances, bill collectors will often start calling. When these calls become frequent, threatening, humiliating, or insulting, it only adds to the stress. Many people in these circumstances do not realize that the Fair Debt Collections Practices Act (FDCPA) and Florida Consumer Collection Practices Act (FCCPA) exist to shield consumers from the worst of the abuses. The FDCPA and FCCPA provide specific guidelines regarding how and when debt collectors can contact consumers, and they impose penalties for violations of their prohibitions against unfair or abusive practices. A debt collector may not:

  • threaten you with physical violence or harm
  • use obscene, profane, or abusive language
  • disclose or publish information about your debts to others
  • make false statements or falsely threaten you with arrest
  • harass you at work without your consent
  • continue to contact you if you have requested that they stop
  • contact you about debts you do not owe
  • contact you directly if you are represented by an attorney

If a debt collector violates one of these provisions, you can recover statutory damages of up to $1,000, as well as the cost of retaining an attorney.
